The Village of Evendale
Regular Council Meeting
June 12th, 2008


Public Discussion:  Mr. Harold Dimond, 10629 Grimsby Lane, addressed council and presented a petition, with 175 signatures, against the zoning changes for the Erickson Retirement Community.  

The Village of Evendale Regular Council Meeting was called to order by Mayor Apking at 7:00 pm.

Roll call- The following council members were present: Ms. Carolyn Smiley-Robertson, Mr. Stiney Vonderhaar, Mr. Bill Puthoff, Jr., Mr. Jeff Albrinck, Mr. Doug Lohmeier, and Mr. John Ranz, Jr..  Also present were: Village Engineer, James Jeffers; Chief Fiscal and Accounting Office, George Snyder; Village Solicitor, Tim Burke; Fire Chief Rick Cruse and Village Clerk, Barb Rohs.

Mayor Apking presented. #08-32 ORDINANCE APPOINTING JOSHUA R. ASBACH, ROBERT J. LEHMAN AND CARLTON E. THOMAS AS FIRE FIGHTER/PARAMEDICS FOR THE VILLAGE OF EVENDALE AND DECLARING AN EMERGENCY .  There was no discussion. A motion to read Ordinance #08-32 by title only was made by Mr. Vonderhaar, seconded by Mr. Puthoff and unanimously approved on roll call. A motion to suspend the second and third readings of Ordinance #08-32 was made by Mr. Puthoff, seconded by Mr. Vonderhaar and unanimously approved on roll call. A motion to adopt Ordinance #08-32 as an emergency was made by Mr. Lohmeier, seconded by Mr. Puthoff and unanimously approved on roll call. Mayor Apking declared Ordinance #08-32 adopted as an emergency.


Oath of Office:

Joshua R. Asbach, Robert J. Lehman and Carlton E. Thomas were each sworn in as Firefighter/Paramedic for the Village of Evendale Fire Department.  Each introduced family and friends and photos were taken.  


Mayor Apking presented the consent calendar.  Mr. Vonderhaar made the motion to accept the consent calendar as corrected, seconded by Mr. Puthoff and unanimously approved.

Report of Mayor and Council Committees:


·       Report of the Police-Finance-Administration Council Committee
1.      Chief Faust has begun the process for reviewing the potential police candidates.
2.      One new police cruiser has been delivered and the second one should be delivered by July 1st.
3.      A committee of employees with representatives from each department has been formed to evaluate the current health care package.

·       Report of the Fire-Recreation-Service-Engineering-GHF Council Committee
1.      Peggy Paff, Executive Director of GHF, addressed council.  Ms. Paff thanked Tracy Techau, CEO of Dan Beard Council, for introducing the GHF to two organizations.  Social Venture Partners (SVP) is a group of retired and semi-retired executives looking to give back both financially and with their business experience.  GHF made it to the top 3 out of 26 Cincinnati non-profits.  GHF is also involved with the United Way BOLD program that stands for Board Leadership and Development program to train business leaders to be productive and effective board members. Without the partnership with the Dan Beard Council, these two opportunities would not of presented themselves.  GHF is very excited about the future and partnership with the Dan Beard Council.
2.      Playground equipment installation is running late but it should be installed by July 4th.
3.      Remember the July 4th celebration and fireworks.
4.      Mr. Vonderhaar thanked everyone for their support during this past week with the death of his mother.
5.      Summer Concert Series is starting.
6.      400 residents attended the Family Pool Party.
7.      240 children involved in the Fun in the Sun.
8.      200 children participating on the Evendale Eagles Swim Team.
9.      Cultural Arts Center- 220 attended open house, 135 took sample classes, 60 taking paying classes.  June 30 is the next session of classes.
10.     GHF- For the 3rd year the Morgan’s Raid will be coming to GHF on July 19/20.

Mayor Apking mentioned that he attended the Mayor’s Convention.  Mayor Apking and his wife visited the new Erickson Retirement Community in Hilliard, Ohio.

Presentation of Ordinances and Resolutions:


Mayor Apking presented # 08-25 ORDINANCE AUTHORIZING MAYOR TO HIRE SEASONAL EMPLOYEES AND SETTING PAY RATES AND DECLARING AN EMERGENCY.  Mr. Puthoff recused himself from this vote.  A motion to read Ordinance #08-25 by title only was made by Mr. Lohmeier, seconded by Mr. Puthoff and unanimously approved on roll call.  A motion to suspend the second and third readings of Ordinance #08-25 was made by Mr. Vonderhaar, seconded by Ms. Smiley-Robertson and unanimously approved on roll call.  Mr. Burke suggested that before the ordinance was adopted, that after each name on the ordinance, the phrase “for payroll purposes this ordinance is retroactive effective 5-8-08”.  A motion to amend this ordinance was made by Mr. Vonderhaar, seconded by Mr. Albrinck and unanimously approved on roll call.  A motion to adopt Ordinance #08-25, as amended, as an emergency was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. Mayor Apking declared Ordinance #08-25 adopted as an emergency.

Mayor Apking presented. #08-29 ORDINANCE AUTHORIZING MAYOR TO HIRE PART-TIME EMPLOYEES AND SETTING PAY RATES AND DECLARING AN EMERGENCY.  A motion to read Ordinance #08-29 by title only was made by Mr. Lohmeier, seconded by Mr. Puthoff and unanimously approved on roll call. A motion to suspend the second and third readings of Ordinance #08-29 was made by Mr. Ranz, seconded by Mr. Vonderhaar and unanimously approved on roll call. A motion to adopt Ordinance #08-29 as an emergency was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. Mayor Apking declared Ordinance #08-29 adopted as an emergency.


Mayor Apking presented Ord. #08- 30 ORDINANCE AMENDING SECTION 1258.04 AND TABLE 1258.07-A OF THE CODIFIED ORDINANCES OF THE VILLAGE OF EVENDALE AND DECLARING AN EMERGENCY. A motion to read Ordinance #08-30 by title only was made by Ms. Smiley-Robertson, seconded by Mr. Puthoff and unanimously approved on roll call. A motion to suspend the second and third readings of Ordinance #08-30 was made by Mr. Lohmeier, seconded by Mr. Vonderhaar and unanimously approved on roll call. A motion to adopt Ordinance #08-30 as an emergency was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. Mayor Apking declared Ordinance #08-30 adopted as an emergency.


Mayor Apking presented Ord. # 08-31 ORDINANCE ENACTING PROVISIONS FOR COMPETITIVE VIDEO SERVICE AUTHORIZATIONS, ESTABLISHING FEES, DEFINING CERTAIN TERMS AND AUTHORIZING THE MAYOR OR HIS DESIGNEE TO PROVIDE CERTAIN NOTICE TO THE VIDEO SERVICE PROVIDERS OFFERING VIDEO SERVICE IN EVENDALE PURSUANT TO STATE AUTHORIZATION AND DECLARING AN EMERGENCY.  Discussion:  The state legislature recently adopted a law that may take away some control from the local governments over the contracting with the cable TV franchise operators.  Over half dozen communities in Hamilton County have adopted this type of ordinance.  This ordinance is meant for the local government to regain some control. A motion to amend the ordinance where “Village Administrator” to “Mayor” was made by Ms. Smiley-Robertson, seconded by Mr. Vonderhaar and unanimously approved on role call.   Ms. Smiley –Robertson questioned who would be providing the VSP’s the fee requirement for Evendale within the 10 days required by the ordinance.  It was determined that the Mayor determines who provides the information.  A motion to read Ordinance #08-31, as amended, by title only was made by Mr. Vonderhaar, seconded by Mr. Ranz and unanimously approved on roll call.  A motion to suspend the second and third readings of Ordinance #08-31 was made by Ms. Smiley-Robertson, seconded by Mr. Vonderhaar and unanimously approved on roll call. A motion to adopt Ordinance #08-31 as an emergency was made by Mr. Albrinck, seconded by Mr. Vonderhaar and unanimously approved on roll call. Mayor Apking declared Ordinance #08-31 adopted as an emergency.  

 
Mayor Apking presented Ord. 08-35 ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN ADDENDUM TO THE CONSTRUCTION AND LEASE AGREEMENT BETWEEN THE VILLAGE, THE DAN BEARD COUNCIL, INC., AND THE GORMAN HERITAGE FARM FOUNDATION AND DECLARING AN EMERGENCY.  Discussion:  Mr. Lohmeier stated the Boy Scout Committee is in favor of the addendum.  A motion to read Ordinance #08-35 by title only was made by Mr. Puthoff, seconded by Mr. Albrinck and unanimously approved on roll call.  A motion to suspend the second and third readings of Ordinance #08-35 was made by Mr. Vonderhaar, seconded by Mr. Puthoff and unanimously approved on roll call. A motion to adopt Ordinance #08-31 as an emergency was made by Mr. Puthoff, seconded by Mr. Vonderhaar and unanimously approved on roll call. Mayor Apking declared Ordinance #08-35 adopted as an emergency.  


Mayor Apking presented Res. #08-09 RESOLUTION APPROVING THE SCHEMATIC AND PRELIMINARY DESIGN OF THE SCOUT ACHIEVEMENT CENTER AND DECLARING AN EMERGENCY.  Mr. Ranz asked that the Dan Beard Council to coordinate with Gorman Heritage Farm on the design of the pavilion.  A motion to read Resolution #08-09 by title only was made by Ms. Smiley-Robertson, seconded by Mr. Ranz and unanimously approved on roll call.  A motion to suspend the second and third readings of Resolution #08-09 was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to adopt Resolution #08-09 as an emergency was made by Mr. Lohmeier, seconded by Mr. Ranz and unanimously approved on roll call. Mayor Apking declared Resolution #08-09 adopted as an emergency.  


Mayor Apking presented the THIRD READING of Ord. #08-17  ORDINANCE APPROVING WATER MANAGEMENT AND SEDIMENTATION CONTROL PLANS FOR DAN BEARD COUNCIL, INC AND AUTHORIZING BUILDING COMMISSIONER TO ISSUE PERMIT AND DECLARING AN EMERGENCY. A motion to adopt this ordinance as an emergency was made Mr. Ranz , seconded by Mr. Vonderhaar and unanimously approved on roll call.  Mayor Apking declared Ordinance #08-17 adopted as an emergency.

Mayor Apking acknowledged Bob Griffin and his support and effort on getting the Dan Beard Council to move to Evendale.  Mayor Apking also thanked the committee and Jack Cameron on their efforts.  Bob Griffin, resident of Evendale, spoke and thanked everyone.  Tracy Techau, CEO of Dan Beard Council thanked everyone and is excited to move the Council to the Village of Evendale.



Mayor Apking presented Ord. #08-36 ORDINANCE APPROPRIATING FUNDS NECESSARY AND PROVIDING FINAL AUTHORIZATION FOR COOPERATION WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR IMPROVEMENTS ON GLENDALE MILFORD ROAD AND DECLARING AN EMERGENCY.  James Jeffers stated the project is out for bid.  Work may begin in the end of July. The amount of turn lanes and lighting timing will change. The “turn on red” has not been determined. A motion to read Ordinance #08-36 by title only was made by Mr. Lohmeier, seconded by Mr. Puthoff and unanimously approved on roll call.  A motion to suspend the second and third readings of Ordinance #08-36 was made by Ms. Smiley-Robertson, seconded by Mr. Ranz and unanimously approved on roll call. A motion to adopt Ordinance #08-36 as an emergency was made by Mr. Lohmeier, seconded by Ms. Smiley-Robertson and unanimously approved on roll call. Mayor Apking declared Ordinance #08-36 adopted as an emergency.  

Other business:
Ms. Smiley-Robertson would like Cultural Arts Committee Reports to be added to the Consent Calendar.  

Hamilton County proposed a 15 year tax abatement for Springdale and Evendale for the GE expansion to the Princeton School Board for approval.  Princeton School Board approved the tax abatement.  GE is expected to announce where they would relocate by end of June.  

 A motion to go into Executive Session for land acquisition was made by Mr. Vonderhaar, seconded by Mr. Albrinck and unanimously approved on roll call.

Motion to adjourn the meeting was made by Mr. Vonderhaar, seconded by Mr. Lohmeier and unanimously approved on roll call.
